Scope
These terms cover the use of the empornat.com website and the web design, hosting, business email, domain, DNS and migration services that Mraen Bilişim ve İnternet Hizmetleri Ticaret Limited Şirketi ("EmporNAT") provides under the EmporNAT brand. Terms specific to a service are set out in the order form or quote; where they conflict with these terms, the order form or quote prevails.
Services
The scope, resources (such as disk space, number of mailboxes, and CPU and memory limits) and term of a service are set out in the order form or quote. Services run in monthly or yearly periods. Renewal details are emailed at least 15 days before a period ends, and the service renews when the next period is paid.
Web design projects
The scope of a web design project, the pages and features to be delivered, the schedule, the number of revision rounds and the payment plan are set out in the quote. The customer confirms that they hold the rights to the text, images and logos they ask us to use. The economic rights in the design and code made for the project, as listed one by one in writing in the quote, pass to the customer once it is paid in full; fonts and open-source libraries used in it remain under their own licences. EmporNAT may show a finished project as a reference only with the customer's written consent.
Support
Support requests are accepted 24 hours a day, 7 days a week at empornat@empornat.com. We aim to send a first reply to every request within 3 hours. This is a target and, unless agreed separately in writing, not a service-level commitment.
Payment
Fees for hosting, email and DNS are invoiced in advance at the start of each period and paid by bank transfer (havale or EFT) to the account on the invoice, by the due date on the invoice. The payment plan for a web design project is set out in its quote. Prices shown to consumers include VAT; quotes to business customers state VAT separately. A service left unpaid past its due date may be suspended no sooner than 7 days after an email reminder; data is not deleted while a service is suspended. If payment is not made within 30 days of suspension, the service may be terminated. The account's data may then be deleted after a final email notice at least 7 days beforehand.
Acceptable use
The services may not be used to send unsolicited bulk email, to host or spread phishing pages or malware, to publish content that infringes others' intellectual property, to attempt unauthorised access to or attacks on other systems, to run open proxies or cryptocurrency mining, or for any purpose contrary to the laws of the Republic of Türkiye. Where such use is found, the service concerned may be suspended without prior notice to protect other customers and the infrastructure, and the customer is informed without delay. Our obligations as a hosting provider under Law No. 5651 are unaffected.
Responsibility
Customers are responsible for the content they upload to their account and for keeping their account credentials secure. Keeping regular backups of their data is the customer's responsibility. Except in cases of intent or gross negligence, EmporNAT's liability is limited to the fee paid for the period in which the damage occurred. Consumers' statutory rights are unaffected.
Disputes
These terms are governed by the laws of the Republic of Türkiye. In consumer disputes, consumer arbitration committees at the consumer's place of residence or where the transaction took place have jurisdiction within the monetary limits announced each year by the Ministry of Trade, and consumer courts above those limits. In disputes between merchants, the Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction.
